1. Scope and General Provisions

1.1 These Terms and Conditions (“T&C”) apply to all purchases made through the online shop operated by Shorinji Kempo e.V. (hereinafter referred to as “we”, “us”, or “the Seller”) in connection with the Shorinji Kempo Taikai training camp (hereinafter referred to as “the Camp”).

1.2 The online shop is exclusively intended for participants of the Camp who are at least 18 years of age, or minors acting with the consent of their legal guardian.

1.3 By placing an order, the customer agrees to these T&C in their entirety. Any deviating terms and conditions of the customer shall not apply unless expressly agreed upon in writing by the Seller.

1.4 The shop is available for a limited period of 14 days only. Orders placed after the closing date cannot be accepted.

2. Products and Availability

2.1 The merchandise offered in our online shop (hereinafter referred to as “Products”) is available in limited quantities. All offers are subject to availability.

2.2 Product images are for illustrative purposes only and may differ slightly from the actual product, particularly with regard to color rendering on different screens.

2.3 We reserve the right to modify, withdraw, or discontinue any Product without prior notice, provided no binding purchase contract has yet been concluded.

3. Order Process and Conclusion of Contract

3.1 The presentation of Products in the online shop does not constitute a legally binding offer, but rather an invitation to place an order.

3.2 By clicking the “Buy Now” or equivalent button, the customer submits a binding offer to purchase the selected Products.

3.3 The Seller will send an automatic order confirmation to the customer’s provided email address upon receipt of the order. This confirmation does not yet constitute acceptance of the offer.

3.4 A binding purchase contract is concluded only upon the Seller sending a separate order acceptance email, or upon dispatch of the ordered Products to the customer, whichever occurs first.

3.5 The Seller reserves the right to refuse any order, for example in cases of apparent errors in the product listing or where stock is no longer available.

4. Prices and Payment

4.1 All prices displayed in the online shop are final prices and include the applicable statutory value added tax (VAT) in accordance with German law.

4.2 Payment is due in full at the time of placing the order.

4.3 We accept the following payment methods:

  • PayPal
  • Credit card (via PayPal)

4.4 By submitting an order, the customer authorizes the Seller to charge the applicable payment method for the total order amount.

4.5 In the event of payment failure or reversal, the Seller reserves the right to cancel the order and release the reserved items for sale.

5. Collection of Orders

5.1 All Products ordered through the online shop are exclusively available for collection at the Camp venue. We do not offer postal or courier delivery.

5.2 Orders can be collected during the following times: July 31 to August 3

5.3 Customers will be notified of the exact collection point and procedures via email prior to the Camp.

5.4 Customers must present either their order confirmation email or a valid photo ID upon collection.

5.5 If an order is not collected during the designated collection period, the Seller will contact the customer by email within 7 days of the Camp’s conclusion to arrange an alternative solution. If no resolution is reached within a further 14 days, the Seller reserves the right to retain the Products and process a refund of the purchase price, minus any applicable handling costs.

6. Right of Withdrawal

6.1 Customers who are consumers within the meaning of § 13 of the German Civil Code (BGB) have the right to withdraw from this contract within 14 days without giving any reason.

6.2 The withdrawal period begins on the day on which the customer or a third party named by the customer (other than the carrier) has taken possession of the goods — in this case, the day of collection at the Camp.

Withdrawal Notice

To exercise the right of withdrawal, customers must inform us:

To meet the withdrawal deadline, it is sufficient to send the communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

6.3 If the customer withdraws from this contract, we will reimburse all payments received, without undue delay and in any event not later than 14 days from the day on which we are informed about the decision to withdraw. We will use the same means of payment as used for the initial transaction, unless expressly agreed otherwise.

6.4 We may withhold reimbursement until we have received the goods back or the customer has supplied evidence of having sent back the goods.

6.5 The customer shall send back or hand over the goods to us without undue delay and in any event not later than 14 days from the day on which the customer communicates the withdrawal. The deadline is met if the goods are sent back before the period of 14 days has expired.

6.6 The customer will bear the direct cost of returning the goods.

6.7 The customer is only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

Exclusion of the Right of Withdrawal

6.8 The right of withdrawal does not apply to:

  • Goods that have been clearly personalised or customised for the customer (e.g. items printed with the customer’s name).
  • Sealed goods that have been unsealed after delivery and are not suitable for return due to health protection or hygiene reasons.

9.2 For all other damages arising from a slightly negligent breach of a material contractual obligation (cardinal obligation), liability is limited to the foreseeable, contract-typical damage.

9.3 Any further liability on the part of the Seller is excluded.

9.4 The above limitations of liability also apply in favour of the legal representatives and vicarious agents of the Seller.

10. Data Protection

The processing of personal data in connection with orders placed through the online shop is carried out in accordance with our Privacy Policy, which is available at our Privacy Policy.

11.2 We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

12. Applicable Law and Jurisdiction

12.1 These T&C and all contracts concluded through the online shop are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

12.2 If the customer is a consumer habitually resident in another EU member state, the mandatory consumer protection provisions of that member state shall also apply, provided they offer greater protection than German law.

12.3 For customers who are merchants, legal entities under public law, or special funds under public law, the exclusive place of jurisdiction for all disputes arising from or in connection with these T&C shall be the registered seat of the Seller.

13. Severability Clause

Should any provision of these T&C be or become invalid or unenforceable, the remaining provisions shall remain unaffected. The invalid or unenforceable provision shall be replaced by a valid provision that comes closest to the economic purpose of the original provision.
